Terms of Service

1. What the service is

SmartSendBox is email marketing software. It finds companies by industry and city from publicly available sources, extracts their business email addresses, and sends from a domain and mailbox that you connect and control.

2. What you are responsible for

• Complying with the rules that apply where your recipients are — the GDPR and ePrivacy in the EU, CAN-SPAM in the United States, CASL in Canada, and any local equivalent.
• The accuracy of what you write. Inventing results, testimonials or offers is your risk, not ours.
• Acting on opt-out requests. Our software records and enforces them automatically; overriding that is a breach of these terms.
• Keeping your account credentials secure and connecting only mailboxes you are authorised to use.

3. What is not allowed

• Uploading purchased, rented or leaked lists.
• Sending content that is unlawful, misleading, or impersonates another person or company.
• Using the service to send to recipients who have opted out.
• Attempting to extract other customers’ data or to circumvent account isolation.

We may suspend an account that does any of these. Where the situation allows it we will tell you first and give you a chance to fix it; where it does not — an active abuse complaint, for example — we may act immediately.

4. What we do not promise

We do not promise a reply rate, a number of customers, or that every message will reach an inbox. Deliverability depends on your domain’s history, your list and your copy, and much of it sits outside our control. We build the software to give you the best odds; we do not sell an outcome.

5. Fees

Plans run month to month with no minimum term. You can stop in any month and the service continues to the end of the paid period. Prices may change; if they do, we tell you before the change applies to you.

6. Ending the agreement

You can close your account at any time. Export your contact list and sending history before you do — after closure your data is deleted within 30 days and we cannot restore it.

7. Liability

To the extent permitted by law, our liability is limited to the fees you paid in the twelve months before the event. We are not liable for indirect or consequential loss, including lost profit or lost business opportunity.
